INFORMATION NOTICE ON PRIVACY

pursuant to Art. 13 of Legislative Decree no. 196 of 30 June 2003

  1. Introduction
    1. Vionnet takes great care in relation to its users' privacy and does everything in its power to protect it. This privacy policy (the "Privacy Policy") governs the collection and processing of the personal data of users who visit the specific area dedicated to e-commerce (http://store.vionnet.com) (the "Website") by accessing our web page at http://www.vionnet.com.
    2. Please note that according to applicable legislation, including Italian Legislative Decree no. 196/2003 ("Personal Data Protection Code"), the processing of the data collected on the Website (the "Data") will be based on the principles of correctness, lawfulness and transparency and will be carried out for the expressly stated purposes and to an extent that is not excessive in relation to the ends for which it is collected.
    3. We request that you read the Privacy Policy carefully, since it will be applicable in all cases should you choose to browse our Website, regardless of whether or not you purchase Vionnet products.
  1. The Data Controller
    1. The Data controller is Vionnet Operations S.r.l. ("Vionnet"), with registered office at 20122 – Milan (MI), Corso Monforte 16, Fiscal Code and VAT no. 07636370962, which independently chooses the processing methods and purposes, as well as the security measures to be adopted to guarantee confidentiality and availability.
  1. Data Processing Contractors
    1. To fulfil the purposes of the Website, Vionnet exercises its option to appoint third parties as Data contractors, who will carry out their activities according to the instructions given by Vionnet. You may request a current list of data contractors from Vionnet at any time by contacting our client services team by email at privacy@vionnet.com, or at our registered office address.
  1. Provision of Data
    1. The Website is freely available for browsing and does not require any registration, except for accessing the reserved personal area that allows you to purchase Vionnet products and request certain special services.
    2. Depending on the specific purposes indicated in each case, supplying Data to Vionnet may be compulsory or optional, according to what is expressly stated. Compulsory fields are marked with an asterisk (*) beside the information requested.
    3. In the event that you refuse to submit the Data marked as compulsory to Vionnet, it will be impossible to fulfil the stated purpose. In particular, you will not be able to complete your registration on the Website and, therefore, you will not be able to purchase products. In contrast, failure to submit the Data marked as optional will not have any consequences in relation to the purpose of collection.
  1. Purpose of Processing
    1. In general terms, Data is collected and processed for the following purposes:
      1. creation and maintenance of the personal user profile for accessing the reserved area of the Website;
      2. fulfilment of purchase orders for products and associated activities;
      3. handling your requests of a technical or commercial nature and for information in general;
      4. inclusion of specific and additional services, such as a "wish list" of products in your personal profile;
      5. sending a newsletter from Vionnet, subject to obtaining your prior specific consent for said processing;
      6. sending promotional and marketing information from Vionnet, subject to obtaining your prior specific consent for said processing;
      7. creating a profile of your browsing habits on the Website and your preferences, subject to obtaining your prior specific consent for said processing; and
      8. statistical analysis of the use of the Website in an anonymous and aggregated form.
    2. A summary of the specific methods will be provided to you at the time of submitting the Data. 
  1. Processing Methods
    1. The Data may be processed by Vionnet and by its processing contractors, as per Clause 3, either electronically or on paper. Vionnet guarantees that personal data submitted through the Website will be processed according to the principles of lawfulness and correctness, in full compliance with the legislation in force, and will apply the highest standards of confidentiality to the data supplied during registration. All the information collected is transmitted via a secure connection in order to prevent third party interception.
    2. Please note that according to legislation there are some types of Data processing that do not require your consent. For example, please be aware that Vionnet may process Data without obtaining your consent when this is necessary in order to fulfil a legal requirement, or when it is necessary in order to perform contractual obligations towards you.
    3. Should Vionnet need to process third party details communicated directly by you (for example, in cases where you have purchased a product to be delivered to someone else, or where the person who pays the price for the purchased product is different from the product recipient, or where the Website user wishes to share one of the Website's services with a friend), Vionnet will provide the third party with this Privacy Policy upon registering the third party's details in its records. However, it remains your responsibility to obtain the consent of the third party before sharing his or her Data. You shall therefore remain solely liable for communicating third party information and Data without the party giving his/her consent and for any improper or unlawful use that may arise.
    4. Please also be informed that your Data will not be transferred abroad to countries, other than those belonging to the European Union, that do not guarantee adequate levels of protection. In the event that this becomes necessary in order to provide you with services or conclude a product purchase agreement with Vionnet, we assure you that the transfer of Data to non-EU countries that do not guarantee an adequate level of protection will be done only after concluding specific contracts between Vionnet and said parties in compliance with applicable law and regulations.
  1. Rights of Data Subjects
    1. Please note that you have the right to obtain confirmation as to whether or not your personal Data is being held, even if it has not yet been registered, and to have a copy of the Data communicated to you in an accessible format.
    2. You also have the right to obtain from Vionnet information regarding: (i) the source of your Data; (ii) the processing purpose and methods applicable to your Data; (iii) the logic applied for processing with the aid of electronic equipment; (iv) the identification details of the data controller and data processing contractors; (v) details of the parties or categories of parties to whom the Data may be communicated or who may come into contact with it in their capacity as, for example, data processing contractors. All this information is contained in the Privacy Policy.
    3. In addition, you always have the right to obtain the following from Vionnet: (i) updates, corrections and additions to your Data; (ii) deletion, conversion into an anonymous format or blocking of your Data if processed unlawfully, including Data for which storage is unnecessary in relation to the data collection purposes or subsequent processing; (iii) confirmation that the operations set out under points (i) and (ii) have been brought to the attention, including in relation to their contents, of those to whom the Data was communicated or sent, except in the event that this notification is impossible or would involve using methods that would clearly be disproportionate in relation to protecting the right concerned.
    4. However, you have the right to object in whole or in part: (i) for legitimate reasons, to processing of your Data, including Data associated with the collection purpose; (ii) to processing of your Data carried out for the purposes of sending advertising or direct marketing material or for performing market research or commercial communication.
    5. You may freely (and at any time) exercise your rights by sending a written request to Vionnet at the postal address of the registered office or by sending an email to the client services team at privacy@vionnet.com.
    6. To guarantee that your personal data is always precise, up-to-date, relevant and complete, please inform us of any changes that arise by contacting us via email atprivacy@vionnet.com, or at our registered office address.
  1. Use of cookies 
    1. Vionnet uses various types of “Cookies” on its Website: these are text files that are sent from a web server (which is the computer from which the website visited operates) to your browser (Internet Explorer, Mozilla Firefox, Google Chrome, etc.) and memorised on the hard drive of your PC when you browse the Website. The Cookie allows the Website to identify your PC every time you access the website with that PC by using the information stored within it.
    2. By using Cookies, we can facilitate your browsing experience within the Website.

  1. Connections to other websites
      1. The Website contains links to other websites that may not have any association with Vionnet. Indeed, Vionnet does not control or perform monitoring activities of these websites and their contents. Vionnet shall not be held liable for the contents of these websites and the rules adopted by them, including in relation to privacy and the processing of the user's personal data while browsing.
      2. The Privacy Policy is not applicable to third party web sites. The Website provides links to these websites solely to help the user to perform searches, assist navigation and to enable internet hyperlinks to other websites. The activation of these links does not constitute any form of recommendation or suggestion in relation to accessing or browsing these websites, or any guarantee in relation to the contents, services or goods supplied and sold by them to internet users.
  1. Security measures
    1. Vionnet adopts appropriate security measures in order to reduce to a minimum the risks of destruction or loss (including accidental) of the Data, unauthorised access or processing without consent or that is inconsistent with the collection purposes stated in the Privacy Policy.
    2. However, Vionnet cannot guarantee that the measures adopted for the security of the Website and the submission of Data and information on the Website will limit or prevent all risks of unauthorised access or transmission of Data by devices belonging to you.
    3. It is always advisable for your computer, or the device with which you browse the Website to be equipped with appropriate software to protect data transmission over the internet, both incoming and outgoing and that your internet service provider has adopted suitable security measures for data transmission over the internet.
  1. Amendments to the Privacy Policy
    1. Vionnet may amend or simply update, in whole or in part, the Privacy Policy of the Website, including as a consequence of changes to legislation or regulations that govern the subject. Users will be informed of amendments or updates to the Privacy Policy on the home page as soon as they are adopted and they will become binding as soon as they are published on the Website.     1. The Privacy Policy is governed by Italian Law and in particular by the Italian Personal Data Protection Code (Legislative Decree no. 196 of 30 June 2003), which governs the processing of personal Data (including Data stored abroad) by any party that is resident or has a head office in Italy.
    2. This is expressly without prejudice to the binding application of different national legislation related to the consumer's domicile or residence.
